Terms for using Seedream 5.0 Pro image generation, subscription credits, uploads, generated outputs, billing, and refunds.

1. Introduction and Acceptance of Terms

Welcome to Seedream 5.0 Pro. Seedream 5.0 Pro is operated by LI ZHENG, an individual / sole trader operating under the laws of China with a business address at Dali Gucheng Ximen, Congyuan Village, Group 7, No. 103, Dali, Yunnan, China. These Terms of Service govern your access to and use of our AI-powered image generation and editing services, including browser-based prompt generation, reference image uploads, image editing, subscription credits, billing, and support, available at seedream-5-pro.com.

By creating an account, subscribing to a plan, using included credits, checking an agreement box at checkout, or otherwise using the service, you confirm that you are at least 18 years of age, have read and understood these Terms, agree to be bound by these Terms and our Privacy Policy, and have authority to accept them for yourself or the organization you represent.

If you do not agree to these Terms, you may not use Seedream 5.0 Pro. Continued use after an update constitutes acceptance of the revised Terms.

2. Service Description

Seedream 5.0 Pro provides browser-based AI image generation and editing. Users can submit text prompts, upload reference images, choose supported model settings, generate one or more images, and use subscription credits for additional usage.

The service is a digital, intangible service delivered through the internet. Upon confirmed payment, access is granted immediately, subject to account status, provider availability, safety review, and these Terms. Because access is delivered immediately, refund limitations apply as described in Section 7.

Seedream 5.0 Pro is an independent product and is not affiliated with, endorsed by, or sponsored by Seedream, ByteDance, or APIMart. References to Seedream, ByteDance, APIMart, or other providers describe integrated AI model, API, or infrastructure capabilities only.

The service may use third-party AI, moderation, payment, email, hosting, database, and storage providers, including APIMart or other configured AI model providers, Waffo Prompt Sift, Waffo Pancake, Creem, and Cloudflare infrastructure. Generation speed, quality, availability, model behavior, supported parameters, and credit costs may change as providers and models change.

3. Account Registration and Eligibility

To generate images, manage credits, subscribe to a plan, or access billing settings, you may need to create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to notify us promptly at support@seedream-5-pro.com if you suspect unauthorized account use, not to share credentials with third parties, and to keep your account and billing email current.

If you register or use the service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Subscription Plans and Included Credits

Seedream 5.0 Pro offers monthly and annual subscription plans for access to AI image generation and editing credits. Current plan details, prices, included credits, billing intervals, and plan benefits are shown on the pricing page and at checkout. The rules below determine the credit cost of each standard image.

Free accounts receive 18 one-time trial credits. Those credits expire seven days after they are granted, do not renew, and are offered for personal evaluation rather than as a commercial-use entitlement.

Monthly subscriptions receive the plan's monthly credit amount immediately after the first successful payment and again after each successful monthly renewal. Each grant expires at the next subscription-month anniversary and unused credits do not roll over.

Annual subscriptions are charged once for the displayed annual amount, but credits are issued one subscription month at a time. The first monthly grant is issued after the annual payment succeeds, each later grant is issued on the subscription-month anniversary, and each grant expires at the following anniversary. Canceling automatic renewal does not end benefits already paid for: monthly grants continue through the paid annual term and stop when that term ends. Months that fully passed while the account was not used are not granted retroactively.

As of the effective date of Version 1.1, the default credit schedule is: Seedream 4.5 and Seedream 5.0 Lite cost 4 credits per output; Seedream 5.0 Pro costs 6 credits per 1K output or 12 credits per 2K output; and every started pair of reference images adds 1 credit per request. For supported multi-output requests, the model base charge is multiplied by the requested output count and the reference-image charge is applied once. The current credit schedule and pre-submission estimate are shown in the product interface, and the server calculates the final charge using the same current rules. Credits charged for a clearly failed task are returned once.

We may modify plan features, plan names, supported models, credit amounts, or introduce new plans. Changes to prices or material plan terms apply to future billing periods unless otherwise required by law.

5. Billing and Payment

By providing a payment method and subscribing to a paid plan, you expressly authorize Seedream 5.0 Pro and its payment processor to charge your payment method on a recurring basis for the applicable subscription fee, taxes, and any amounts shown at checkout. This recurring authorization remains in effect until you cancel under Section 6.

Your subscription renews automatically at the end of each billing period unless canceled before renewal. For annual subscriptions or other renewal scenarios where advance notice is required by law or payment network rules, we will provide renewal notice where practical using your account email or in-product messaging.

Prices are exclusive of applicable taxes, including VAT, GST, sales tax, or similar taxes, unless the checkout states otherwise. Where required, taxes may be calculated, collected, and remitted by the payment processor or Merchant of Record.

Payments are processed by third-party payment providers. Payment card data is processed by our PCI-DSS compliant payment processor Waffo Pancake, or another configured payment provider shown at checkout, and full card numbers are not stored by Seedream 5.0 Pro.

The name on receipts, checkout, or card statements may show Seedream 5.0 Pro, Waffo Pancake, Creem, or the billing descriptor configured for the active store. If you do not recognize a charge, contact us before opening a bank dispute so we can investigate.

6. Cancellation Policy

You may cancel a subscription at any time from the billing settings page at /settings/billing when self-service billing is available for your account. You may also contact support@seedream-5-pro.com from your account email for help with cancellation.

Cancellation normally takes effect at the end of the current billing period. Your subscription remains active until that period ends, you will not be charged for subsequent billing periods, and included subscription credits remain subject to the plan rules and expiration terms that issued them.

For an annual subscription, cancellation stops the next annual renewal but does not shorten the annual term already paid for. Plan access and monthly credit grants continue until the end of that paid annual term, subject to these Terms.

If you request account deletion after cancellation, service data associated with the account will be deleted or anonymized within 90 days where legally permitted. Billing, security, tax, fraud-prevention, and legal records may be retained as described in our Privacy Policy.

7. Refund Policy

Because Seedream 5.0 Pro is a digital, intangible service and access is granted immediately after confirmed payment, subscription fees are generally non-refundable except as described in this section or as required by law.

Eligible refund cases include first-time subscriber refund requests made within 7 days of the initial charge, duplicate charges, verified billing errors, and service-side failures that prevent delivery of a paid plan. Refunds may be denied for policy violations, account abuse, excessive generation usage, chargeback misuse, or requests outside the refund window unless applicable law requires otherwise.

To request a refund, contact support@seedream-5-pro.com with your account email, order or transaction information, and a short description of the issue. We will review and respond to refund requests within 3 business days. Approved refunds are returned through the original payment method where supported by the payment provider. Processing time after approval may depend on the payment network or issuing bank.

If applicable consumer law grants mandatory withdrawal or refund rights, those rights are preserved.

8. Billing Disputes

If you believe there is an error in a charge, contact support@seedream-5-pro.com before disputing with your bank. Include your account email, transaction ID if available, approximate purchase date, and a description of the issue.

We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days where the payment provider makes that possible.

9. AI Output and Intellectual Property

Subject to these Terms, AI-generated content produced in response to your inputs is owned by you. You may use generated outputs for lawful purposes consistent with these Terms, the Acceptable Use Policy, provider restrictions, and the rights of others.

By submitting prompts, reference images, uploaded files, or other content to the service, you grant Seedream 5.0 Pro a limited, non-exclusive license to process those inputs solely to provide, secure, troubleshoot, and improve the service for your account. We do not use your inputs to train AI models without your explicit consent.

You represent that you have the rights and permissions needed to upload, process, and use your inputs. Paid plans may be used for commercial projects subject to these Terms and provider restrictions. You remain responsible for confirming all copyrights, trademarks, likeness and publicity rights, brand-asset permissions, and other third-party rights required for each use.

AI-generated outputs may be similar to outputs generated for other users and may not be unique. Outputs may be inaccurate, incomplete, or unsuitable for a specific use. We do not guarantee that generated images are free of third-party rights claims, factually accurate, legally cleared, or accepted by any platform, marketplace, advertiser, or regulator.

10. Acceptable Use Policy

You may use Seedream 5.0 Pro only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy.

You agree not to use Seedream 5.0 Pro to upload, prompt for, generate, edit, distribute, or facilitate:

  • NSFW, adult, pornographic, sexually explicit, or sexually suggestive content.
  • Sexual content involving minors, child sexual abuse material, grooming, or any content that exploits, sexualizes, or harms children.
  • Non-consensual intimate imagery, sexual deepfakes, impersonation, deceptive identity content, or content intended to mislead people about real events.
  • Face-swap, deepfake, or face-manipulation use cases that violate another person's rights, consent, safety, or applicable law.
  • Harmful, violent, threatening, hateful, harassing, extremist, self-harm, or abusive content.
  • Illegal, defamatory, fraudulent, phishing, malware, spam, evasion, or cyberattack content.
  • Content that infringes intellectual property, privacy, publicity, contractual, or other rights.
  • Confidential, regulated, or highly sensitive information unless you have authority to process it through the service.
  • Unauthorized access, scraping, reverse engineering of private APIs, interference with service performance, credit abuse, or rate-limit evasion.
  • Resale, sublicensing, or automated access to the service unless we have agreed in writing.
  • Any use that violates applicable law, regulation, card network rule, provider rule, or payment processor policy.

Given the AI-powered nature of the service, you also agree not to use service inputs, outputs, model responses, or derivatives to train, fine-tune, benchmark, distill, or develop a competing artificial intelligence or machine learning model without our written permission; systematically scrape, extract, or harvest outputs at scale; or represent AI-generated outputs as the work of a human professional in contexts where that misrepresentation could cause harm.

We may block prompts, reject generations, remove access to content, suspend accounts, or terminate access when we believe these Terms, the Acceptable Use Policy, provider rules, or applicable law have been violated.

11. Data, Privacy, and Security

Your use of the service is governed by our Privacy Policy at seedream-5-pro.com/privacy-policy. Payment card data is processed by Waffo Pancake or another active PCI-DSS compliant payment provider shown at checkout and is not stored on Seedream 5.0 Pro servers.

Prompts for image generation may be screened before they are sent to AI providers. If a prompt is blocked, flagged, or cannot be reviewed because a moderation provider is unavailable, the generation may be rejected. You may not try to bypass, disable, or manipulate moderation systems.

We retain account, billing, generation, security, and support records as described in the Privacy Policy, including records needed for tax, accounting, security, fraud prevention, dispute handling, and legal compliance.

12. Disclaimers and Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or accuracy of AI outputs.

AI-generated outputs may be inaccurate, incomplete, outdated, unexpected, or unsafe for a particular use. Do not rely on outputs for legal, medical, financial, safety-critical, or other professional advice. Always review and verify generated content before relying on it or publishing it.

To the maximum extent permitted by law, Seedream 5.0 Pro and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, payment disputes, provider outages, or claims arising from your use of generated content. Our total liability for any claim will not exceed the amount you paid to Seedream 5.0 Pro in the 12 months preceding the event giving rise to the claim.

13. Term and Termination

These Terms remain effective while you use Seedream 5.0 Pro. We may suspend or terminate your account if you materially breach these Terms, violate the Acceptable Use Policy, create legal or safety risk, misuse credits or payments, disrupt the service, engage in fraudulent activity, or if suspension or termination is required by law or provider policy.

If we terminate for reasons other than your breach, fraud, abuse, legal risk, or provider restriction, we may provide a pro-rated refund or service credit for any unused prepaid period where required or appropriate. You may stop using the service at any time and may request account deletion by contacting support@seedream-5-pro.com.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of China, without regard to conflict-of-law rules. Before initiating any formal proceeding, please contact support@seedream-5-pro.com so we can attempt to resolve the dispute informally.

Courts with competent jurisdiction in China will have authority to resolve disputes unless applicable consumer protection law requires otherwise.

15. General Provisions

We may update these Terms as the service changes. Material changes will be notified by email, website notice, or in-product messaging at least 14 days before the effective date where practical and legally required. Continued use after the effective date means you accept the updated Terms.

If any provision is found unenforceable, the remaining provisions continue in full effect. You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.

The English version of these Terms controls to the extent permitted by law if there is a conflict between translations.
